Job Opening: Staff Attorney (Temporary)

General Description:

This is a temporary, six-month position that starts December 2017 and ends May 2018. The position advocates on behalf of low-income clients living with HIV/AIDS and/or mental health issues to secure public disability income and/or health insurance benefits including Social Security Disability Insurance (SSDI), Supplemental Security Income (SSI), Medi-Cal, Medicare, etc.

Position Responsibilities Include:

  • Assessment: Performs individual assessment of needs related to disability income benefits and health insurance. Helps identify and assist in breaking barriers to benefit entitlements, including accessing medical care, treatments and psychiatric and/or psychological evaluations. Works with clients within a Harm Reduction Approach.
  • Benefits Advocacy: Provides direct legal assistance and representation to clients within a harm reduction approach. Assists clients to apply and enroll in public benefits such as SSDI/SSI, Covered CA, Medi-Cal, etc. Advocates for clients on issues related to accessing health insurance and income benefits. Follows claims throughout administrative claims and appeals processes. Negotiates with governmental entities, disability analysts, private insurance companies, etc. as needed. Files appropriate appeals and paperwork and develops/obtains supporting evidence.
  • Hearings: Prepares cases for appeal and appears before administrative tribunals. Files appeals on unfavorable decisions. Develops/obtains supporting evidence. Performs legal research. Prepares clients for testimony at hearings. Prepares questions for cross-examination of expert witnesses. Writes pre- and post-hearings legal briefs.
  • File Management: Prepares cases for appeal and appears before administrative tribunals. Files appeals on unfavorable decisions. Develops/obtains supporting evidence. Performs legal research.   • Special Projects: Assists the Managing Legal Director and Supervising Attorneys on special projects as necessary.

Qualifications:

  • Active member of the California State Bar.
  • 1-2 years of Social Security and/or healthcare advocacy experience preferred.
  • Demonstrated ability in database management and file maintenance.
  • Ability to be sensitive to and work well with low-income individuals, people with psychiatric disabilities, people with HIV/AIDS, people of color, active drug users, people with a history of homelessness or incarceration and people in the LGBT community essential.
  • Ability to work effectively as a team.
  • Knowledge of harm reduction theory and practice as applied to legal services.
  • Bilingual and bicultural (Spanish, Cantonese, Mandarin, Arabic, Vietnamese or Russian) highly desirable.
